Article 1
Introduction
This Privacy Policy has been issued by Trackdesk s.r.o., registered in the commercial register administered by the Municipal Court in Prague under ref. no. C 364270, ID: 14349043, seat: Slezská 844/96, Vinohrady, 130 00 Prague 3, Czech Republic (hereinafter “Provider”) for its contractual partners (“Customer”).
This Privacy Policy forms an integral part of the General Terms of Service issued by Provider. Any term used in this Privacy Policy that is not explicitly defined herein shall be interpreted according to the General Terms of Service.
Article 2
Electronic communication
Customer may set a level of confidentiality of electronic communication at Provider’s website; by the choice of the settings, Customer decides on granting a consent to certain categories of data saved in Customer’s terminal device (hereinafter “cookies”) to be processed.
Customer may refuse any consent to any processing of cookies without being deprived of the ability to visit Provider’s website and browse its content.
Customer acknowledges that certain services are technically dependent on processing of certain categories of cookies. Customer may recall any consent to processing of cookies by changing the settings of a level of confidentiality of electronic communication.
Customer acknowledges certain messages will sent to Customer as an integral part of Service and, therefore, no further Customer’s consent will be required for those messages to be sent.
Customer hereby grants a consent to Provider for sending a single message to Customer following the lapse of Free Trial, informing Customer about Provider’s offer of Service.
Article 3
Personal Data Protection
Provider will process Users’ personal data to the extent necessary for the provision of Service. However, Provider will not
a) process special categories of Users’ personal data pursuant to Art. 9 of GDPR or personal data related to criminal convictions and offences pursuant to Art. 10 of GDPR;
b) transfer Users’ personal data to a third country or an international organisation.
Customer will be a controller in relation to any User’s personal data processed by Application through Customer’s profile. Provider as a processor will process such personal data within Customer’s profile existing on their website for the duration of Agreement.
Taking into account the state of the art, the cost of implementation and the nature, scope, context and purposes of processing within the framework of Service as well as the risks of varying likelihood and severity for rights and freedoms of natural persons posed by the processing, Provider has implemented the appropriate technical and organisational measures in order to ensure a level of security appropriate to relevant risk.
Provider will provide Customer with a cooperation to fulfil Customer’s obligation to respond to requests for exercising Users’ rights.
Customer and Provider will provide to each other all necessary cooperation and information necessary for dealing with the Office for Personal data protection or other authorities.
Customer hereby accepts the following guidance:
a) Provider may process Customer’s or User’s personal data without Customer’s or User’s consent as such processing is necessary for the operation of Service and thus for the fulfilment of Agreement. Such processing may include storage of such data, communication with Customer and User in connection with the Service, e.g. to inform about new functions, possible changes or new services, provided by Provider. In some cases, Provider may retain the data for a longer period, maximally 1 year, in order to protect the rights of the Customer, User or Provider in connection with possible legal issues, incl. disputes. Provided may retain identification data of the Customer in order to meet the legal requirements, especially arising from accounting and taxation rules.
b) Provider may use a third party to process some personal data, especially technical partners, ensuring storage of the data. In such case, information about such partner will be available on the following website: https://trackdesk.com/.
c) Customer has namely the following rights in relation to their personal data: the right to access, the right to rectification or erasure and the right to data portability. To apply any of these rights, Customer may contact Provider through this e-mail address: support@trackdesk.com.
d) Customer has a right to file a complaint with the Office of Personal Data Protection (www.uoou.cz).
